Welcome to www.besocks.com (hereinafter, besocks.com). Access to besocks.com and its use, as well as the purchase of BESOCKS products, implies reading, knowledge and acceptance of these General Conditions of Use (hereinafter, Conditions of Use).
The products purchased on besocks.com are sold directly by KARMENBYSOMETHING, S.L. , (hereinafter, BESOCKS).
In compliance with article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, the following identifying data of the owner of the Website are exposed: KARMENBYSOMETHING , SL , ("BESOCKS") is a commercial company with registered office in Torrente (Valencia), Avda. Barcelona 92, number 3 - Entresuelo F, C.P. 46900 and email hello@besocks.com. KARMENBYSOMETHING, SL, is duly registered in the Commercial Registry of Valencia.
- PURPOSE OF CONTRACT.
These Conditions of Use make up the entire contract through which the conditions of purchase of the products made available to users are regulated by by BESOCKS.
Access to besocks.com or its use by the user, as well as the purchase of any product, necessarily implies, and without reservation, the knowledge and acceptance of these Conditions of Use, therefore, recommends that the user read them carefully every time he wants to buy a product.
- PURCHASE OF PRODUCTS.
2.1. HOW TO BUY PRODUCTS.
To make purchases, the user must follow the purchase procedure established in besocks.com, read and accept these Conditions of Use and select “FINISH PURCHASE ”(the“ Order ”). Next, BESOCKS will send an email to the user confirming the "Order Acceptance" and the "Purchase Confirmation", so the contract between the user and BESOCKS will be finally formalized. Only those products indicated in the Order will be the subject of the contract.
2.2. PRODUCTS AVAILABILITY.
All Orders are subject to product availability. In the event that, once the Shipping Confirmation has been sent, BESOCKS is unable to dispose of the requested Product due to any circumstance, it will contact the user as soon as possible, informing them of this fact. In this case, BESOCKS may:
(i) offer the user a product with characteristics and specifications similar to the one initially requested, as long as these are consistent with the user's needs and respecting the price paid by the user; and / or,
(ii) offer the user to cancel the requested Order by refunding the amount paid for it, within fourteen (3) business days.
2.3. REFUSAL TO PROCESS AN ORDER.
BESOCKS will do everything possible to always process all Orders, but there may be exceptional circumstances that force it to reject the processing of an Order after it has been sent. the Confirmation of the order, so BESOCKS reserves the right to do so at any time, at its sole discretion and if the circumstances really require it.
BESOCKS reserves the right to withdraw any product from besocks.com at any time and to remove or modify any material or content thereof, not being responsible to the user or to any third party for the fact of remove or modify any product from besocks.com, regardless of whether said product has been sold or not.
2.4. PRODUCT GUARANTEE.
It will be understood that the Products are in accordance with the Conditions of Use provided that they meet all the requirements expressed below:
(i) They conform to the description made by BESOCKS and possess the qualities of the product that BESOCKS has presented to the user in the form of a sample or model.
(ii) They are suitable for the uses that are ordinarily destined for products of the same type.
(iii) They are suitable for any special use required by the user when it has been made known to BESOCKS, provided that BESOCKS has accepted that the product is suitable for such use.
(iv) Present the usual quality and performance of a product of the same type that the user can expect, taking into account the nature of the product.
In the event of being proven that the product does not conform to the established specifications , BESOCKS will proceed, when appropriate, to the replacement, price reduction or termination of the contract, such negotiations being free
